What Happens if I Have Passengers When I’m Stopped for a DUI?

Farragut, TN College DUI LawyerHaving adult passengers in the car when you are stopped for a DUI does not increase penalties in and of itself. Having minors in the car, however, can significantly increase them automatically. If there are injuries, penalties can be more severe for having either adult or minor passengers.

If you were stopped for a DUI with other people in the car in 2026, a Knox County, TN DUI lawyer can explain how their presence may affect your case.

How Does the Age of Your Passengers Affect A DUI Stop in Tennessee?

A first DUI carries at least 48 consecutive hours in jail, and up to 11 months and 29 days. If your blood alcohol concentration was 0.15 percent or higher, the minimum rises to seven consecutive days. This is true even if you had adult passengers in the car.

When there is a child present, consequences are more severe. A DUI with a passenger under 18 carries a mandatory minimum of 30 more days in jail (Tennessee Code Section 55-10-402). This time is served on top of any other jail time for the DUI.

The law applies to any passenger under 18. Your relationship to the person doesn’t affect the charge. A younger sibling, a cousin, or a 17-year-old friend you’re driving home all qualify.

What Happens if a Passenger Is Hurt in a Tennessee DUI Accident?

An accident that seriously injures any passenger can lead to a separate felony charge, such as vehicular assault. A death can lead to a vehicular homicide charge. These carry far more serious penalties than a standard DUI. If a child passenger suffers serious bodily injury, the DUI can become a Class D felony. If a child is killed, it can become a Class B felony.

An injured passenger may also be able to file a civil claim against the driver for medical bills and other losses. This is separate from the criminal case.

Can Your Passengers Get in Trouble During a Tennessee DUI Stop?

Your passengers usually won’t be charged with DUI even if they’ve been drinking, since the charge applies to whoever is driving or in physical control of the car.

Passengers under 21 who have been drinking may be charged with underage possession or consumption. This comes up often with college students coming home from a game or a party. A passenger found with drugs could also face a separate possession charge.

If a passenger is sober and has a valid license, it’s possible that the officer may let them drive the car away instead of having it towed.

Can Your Passengers Be Witnesses in Your Tennessee DUI Case?

Officers often talk to passengers during a DUI stop. What your passengers say about where you’d been, what you drank, and how you were driving may end up in the police report. Prosecutors can later subpoena them to testify.

A passenger’s account can help your defense in some cases. They may be able to say how much you actually drank. They also might be able to offer a reasonable explanation for something an officer read as a sign of impairment.

Don’t try to tell your passengers what to say. Pressuring a witness can create new legal problems for you. Instead, take these steps after the stop:

  • Write down the names and phone numbers of everyone in the car
  • Make notes about where you were, what you drank, and when
  • Avoid discussing the arrest on jail phone calls, which are often recorded
  • Don’t post about the stop or the hours before it on social media

You also have the right to decline to answer an officer’s questions about your drinking. You can politely say you’d like to speak with a lawyer first, with no penalties.
